Casual Employment


Please be advised: changes to the definition of casual employment and the process for casual conversion to full-time or part-time employment were introduced by the Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024.

On 26 August 2024, new provisions relating to casual employment will commence under the Fair Work Act 2009.

The guidance material set out below is currently under review. Further advice will be developed in relation to the forthcoming changes to casual employment.

Members are reminded that the deadline of 27 September 2021 to comply with new obligations regarding casual employment is fast approaching. Full details regarding these changes can be found in this article.

Eligibility for casual employees to be offered conversion is set out at Section 66B of the Fair Work Act. Circumstances where employers are not required to offer conversion, including where there are reasonable grounds not to make an offer, are set out at Section 66C.
